New U.S. Public Charge Rule Takes Effect September 18: What Green Card Applicants Need to Know

A major change is coming to the U.S. immigration system this fall, and green card applicants should pay attention to September 18.

The Department of Homeland Security has finalized a new public charge rule that rescinds the 2022 regulations and gives immigration officers broader discretion when deciding whether certain applicants are likely to become a public charge. The rule takes effect September 18, 2026, and applies to adjustment-of-status applications postmarked or submitted electronically on or after that date.

Under the new approach, officers can look at the full picture, including factors such as an applicant’s age, health, family situation, income, financial resources, education and skills, as well as relevant evidence involving means-tested public benefits.

But here’s an important distinction: using a public benefit does not automatically mean someone will be denied a green card. The rule calls for an individualized, case-by-case review based on the totality of the circumstances.

The change could matter most for people seeking permanent residence through immigration categories that are subject to the public charge ground of inadmissibility. Some immigration categories are exempt.

There is also a transition date to remember. Benefits received before September 18 will generally be considered under the previous 2022 framework, while applications for adjustment of status submitted on or after September 18 will be handled under the new framework.
