A federal appeals court has temporarily extended Temporary Protected Status (TPS) for Haitians by three days, allowing approximately 350,000 beneficiaries to remain legally in the United States and keep their work authorization through Monday, July 27, while the court considers the case.
The emergency order was issued just hours before the protections were set to expire, providing temporary relief for Haitian families across the country. The extension does not resolve the case but gives the court additional time to review legal arguments over the future of Haiti’s TPS designation.
Haiti was first granted TPS following the devastating 2010 earthquake. The humanitarian program allows eligible nationals from countries facing extraordinary conditions, such as natural disasters, armed conflict, or political instability, to live and work legally in the United States. Since then, Haiti’s designation has been extended multiple times because of ongoing gang violence, political unrest, and worsening humanitarian conditions.
The three-day extension is especially significant in South Florida, home to one of the nation’s largest Haitian communities. An estimated 158,000 Haitian TPS holders live in Florida, where many work in healthcare, hospitality, construction, education, transportation, and other essential industries.
Local leaders welcomed the court’s decision but stressed that it is only a temporary measure. Many continue to call on Congress and federal officials to pursue a longer-term solution that provides greater certainty for Haitian families who have lived and worked in the United States for years.
The legal challenge over Haiti’s TPS designation is expected to continue, with the appeals court set to revisit the case before the temporary extension expires. Until then, eligible Haitian TPS holders will continue to receive protection from deportation and remain authorized to work in the United States.
