Haitian-American North Miami Mayor Alix Desulme has been removed from the November 3 ballot after a Miami-Dade Circuit Court judge ruled that he failed to properly pay his candidate qualifying fees under Florida law. The decision, issued as early voting began, effectively leaves challenger George Morgan as the sole remaining candidate in an unopposed race.⁠ ⁠ Circuit Judge Beatrice Butchko Sanchez ruled that Desulme’s two TD Bank cashier’s checks submitted on August 10 for $4,494 to the City of North Miami and $898.80 to the Election Trust Fund did not qualify as checks drawn directly on his campaign account, as required by Florida Statute § 99.061(7)(a)1. The instruments were bank-issued official checks signed by bank representatives rather than Desulme’s designated campaign treasurer. The judge rejected arguments of substantial compliance, writing that she considered whether a “no harm, no foul” approach could excuse the defect but concluded it could not, while noting the court does not wish to disenfranchise voters.⁠ ⁠ Morgan filed an emergency complaint on October 8 challenging Desulme’s eligibility. Miami-Dade County subsequently posted a notice to voters stating that a candidate in the mayoral race had been disqualified, resulting in an unopposed race in which “a vote cast in this race will not change the outcome as the remaining candidate is deemed by law to be elected.” Notices are expected at polling sites, on vote-by-mail ballots, and on the Supervisor of Elections website.
